Bought my cargo van back in September of 2008. Dealer wanted @1800 for it, and I said 1500. We agreed on the $1500 and the remainder to be worked out(Barter). My detailing services, up to $300 for the payoff. Months go by and the guy never calls me to come out, nor does he answer or return calls. He finally called last month and wanted me to come out THAT DAY to detail some cars. I was already booked for the day... and the rest of the week. I had enough and said I would just pay the remainder. I finally got the time to make a payment (same week). Paid via phone with my CC. A few weeks go by, and no title in the mail. I call and he said he'll send it right out. Nothing. Again, I call and he said he will tell his Wife, whom deals with the titles, to get it out to me. Nothing. This was 2 weeks ago. So I call again today. He said his Wife has been out for a few weeks and I need to call back next week. He said there was nothing wrong with the paperwork, which is making me think he has something wrong with the paperwork, or didn't have a title in the first place. I am giving them a call back on Monday. No, I am driving there on Monday to get my title. If I do not leave with it in hand, who/how do I report it to? I have never had any issues before, so I do not know.
I wouldn't have bought a van first with "bartering" as part of payoff. No title in hand, no car. Do you have the paperwork or anything in writing? Try calling a lawyer and see what they say?
Drive over there on Monday to get your title. They should have it right there lying around if there were no issues. Who did you buy from it, a dealership? If that's the case, you can always report them.
Also, do you have receipts for the original payment, the $300 payment, and the info on CC statements? This will help also, if you do indeed have them. Any documents of sale and payment are needed if going for any kind of legal action.
Yes, I have all the original paperwork, signed, receipts, and CC statements. I have all the paperwork from the sale. I was to get the title when the barter was complete, which all was in writing as well. Just thought I'd ask in-case Monday goes sour. Yes, Pete, it was a dealer in Liberty Hill
Here in Alabama, "Failure to Deliver Title" is a misdemeanor crime and an arrest warrant can be issued for same and the miscreant is brought to trial. The action is started by calling the police (or whoever has jurisdiction, ie: sheriff), making a report, then have an ex-parte (just you, not the dealer also) hearing before the Magistrate to issue an arrest warrant.
